California Divorce Law

1. California Grounds for Divorce

California is a “no-fault divorce” state, which means that there does not need to be any showing of wrongdoing on the part of a spouse for the other to file for divorce.

2. Living in California

To file for divorce, one spouse must have lived in California for the last six months.

3. Filing Divorce Petition

You must also live in the county where you file the divorce petition for at least three months before filing.

Divorce Attorney

Divorce is the termination of a marriage,  terminating the duties and responsibilities linking the parties. These laws require the permission of a court in a legal process, which may involve questions of spousal support, child custody and/or support and the division of property and/or debt. Divorce is usually a stressful process like most major life changes since it affects other people as well such as children.

There are few instances in life that are as difficult as filing for divorce. It can be an exceptionally emotional and tiresome process. Luckily, having a divorce attorney who is both knowledgeable and compassionate can improve the results of your case and help you move forward.

When parties cannot come to an agreement on issues of divorce, an impartial 3rd party can mediate their issues. This way, both money and time may be saved by avoiding the courts. Our mediators can help solve your issues in a timely manner.

When navigating your case, you and your spouse may choose to work through negotiations together and come to an agreement on the many decisions that must be made. This is considered an uncontested divorce. If you cannot cooperate and compromise, however, you will have to pursue a contested divorce, wherein a judge will decide and order the terms of your divorce.

Our Attorneys also assist in matters such as

Child custody

Child support

Property division
